Washington, D.C., February 9, 2024 — The U.S. Citizenship and Immigration Services (USCIS) has officially announced an adjustment in the filing fees for Form I-907, Request for Premium Processing. This adjustment, intended to account for inflation, is set to take effect on Monday, February 26, 2024. The final rule, issued on December 28, 2023, outlines the specific fee increases across various immigration form classifications.

The updated fee structure includes significant changes for key forms utilized in the immigration process. Form I-129, Petition for a Nonimmigrant Worker, will increase from $1,500 for H-2B or R-1 nonimmigrant status and $2,500 for all other classifications to $1,685 and $2,805, respectively. Similarly, the fee for Form I-140, Immigrant Petition for Alien Worker, will rise from $2,500 to $2,805 for specified employment-based classifications. Other affected forms include Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization, which will also experience fee adjustments.

USCIS emphasizes the importance of adhering to the new fee schedule to avoid processing delays. Applications postmarked on or after February 26, 2024, that comply with the updated fees will be accepted and returned to the applicant. This measure ensures the agency’s continued commitment to efficient and effective service delivery amidst rising operational costs.

The fee adjustment is a critical step towards sustaining the agency’s operational integrity and its ability to provide timely processing for premium services. USCIS encourages applicants and their representatives to review the detailed fee schedule and submission guidelines on the USCIS website to ensure compliance with the new requirements.
