Taiwan implements new reforms to safeguard the rights of migrants and maintaining enforcement

The Taiwanese government has announced amendments to the Immigration Act and related regulations that will take effect starting January 1, 2024. These changes are intended to create a friendlier environment for foreigners living in Taiwan and strengthen immigration enforcement.

The revised laws include several measures to protect the rights of immigrant spouses and families. For example, immigrants who divorce due to domestic violence can continue residing in Taiwan even if they have no underage children. Spouses of deceased Taiwanese citizens can also apply for residency if they have underage children with Taiwanese nationality.

Professionals with special talents or achievements can now apply for permanent residency for their spouses and dependent children. This change encourages skilled foreigners to settle in Taiwan long-term by making it easier for families to stay together.

The amendments also relax rules around stays and residency permits. Foreign students can extend their stay one year after graduation, with an additional extension possible. Lawyers are now permitted to accompany applicants during immigration interviews.

Penalties for immigration violations will be harsher under the new laws. Overstaying visas now carries fines of NT$10,000–50,000 (US$321–1,605) plus potential entry bans of up to seven years. Arranging illegal employment for foreigners can incur fines of up to NT$1 million (US$32,097).

Overall, these updates to Taiwanese immigration law strike a balance between attracting global talent and maintaining enforcement. Friendlier visa policies coupled with stronger penalties for violations create an environment where law-abiding foreigners are welcomed while immigration abusers are deterred. As Taiwan continues positioning itself as an open and progressive Asian society, these amendments help align the immigration system with that vision.
